Documenting the Disability

Some counties will require a copy of an Individual Education Plan (IEP) to be submitted with the guardian advocate petition paperwork.  However, the IEP must list the underlying developmental disability in order to be used for this process.

If the adult with developmental disabilities has or previously had an IEP, please bring a copy of the most current IEP when you file.  You may be asked to include the IEP when you file your petition.

If there is no IEP or it does not list the underlying developmental disability, a letter from a doctor noting or diagnosing the developmental disability can also be used in its place.
